Truck Makers Tell Scotland’s Justices Collusion Suits Are Late

By Bonnie Eslinger (November 18, 2021, 8:31 PM GMT) — Counsel for Daimler AG urged Scotland’s highest court on Thursday to toss litigation from several local governments suing a group of truck makers in the wake of a European Commission finding that the manufacturers had colluded on pricing, arguing it was filed too late.

A law that pauses a five-year filing deadline in certain circumstances was wrongly applied to the cases, which were brought in February 2019, Roddy Dunlop QC of Axiom Advocates told the Scotland Court of Session at the close of a two-day hearing.
